1. Terms of reference

To make this list of Terms and Conditions more user friendly, we want to start by introducing you to what we mean when using some of the key terms in the text:

  • "App" refers to the Dash app that can be downloaded in the App Store or Google Play to your phone or tablet.
  • "EU" refers to the European Union.
  • "DK" refers to Denmark.
  • "Platform" is used to describe our Dashboard, App and online services and products in unison.
  • "Partner" or "Store" refers to the businesses (e.g. coffee companies, bakeries etc.) using the Platform to provide their loyal customers a digital stamp card.
  • "Cookie Policy" (and collectively "Cookie Policies") refers to the cookie policies for our Users and Companies as applicable.
  • "Dash" (and variously "we," "us" and "our") refers to our company Dash ApS, Toldbodgade 11 3 th, 1253 København K, Denmark.
  • "Website" covers all domains on usedash.io.
  • "User" (and "you" and "your") refers to you as a consumer using the Dash app.
  • "Profile" (and "Account") refers to your personal relationship with Dash and contains your profile details and your associated stamps/stamp cards etc.
  • "Product" refers to any product provided by a Partner, which has been purchased or accessed through the App

2. Joining Dash

2.1 Our mission

Dash is on a mission to strengthen the relationship between consumers and small and medium sized businesses (SMBs) in the retail sector through better loyalty management. The initial product of the Dash mobile application is digital stamp cards where you, as a consumer, can collect stamps when you purchase specific products at your preferred stores and be rewarded for your continued loyalty through free gifts. Dash will continue to introduce new features for improved loyalty management post our initial launch.

2.2 Dash Platform

Dash operates as the "middle-man" between companies and consumers. We facilitate a platform where you can interact with your favorite companies through loyalty tools such as a digital stamp card. The experience of the Dash app is intended to be personalized to your profile, your needs, and to match your in-app behavior.

2.3 Benefits of Dash

By using the Dash app you can more easily be rewarded for your loyalty and more efficiently support your local and preferred stores. In contrast to physical stamp cards, the digital Dash stamp card enables companies to gain much more insight to their loyal customer base and to better utilize these insights to strengthen their business. With your consent, you can receive relevant offers that are personalized to you, based on your demographic profile, your app usage, your preferences, and your present location.

2.4 Relationships of Dash

Please always bear in mind that Dash does not own, control, offer or directly administrate the product types related to the stamp card or the rewards put forward by the companies present in the Dash app. Neither is Dash directly a part of the reward physically given by the company nor any voucher or similar sold on the Dash app.

3. What is covered by these Terms and Conditions?

3.1 A Legal Agreement

These Terms and Conditions ("Terms") are a binding legal agreement between you as a User and the Dash app. In these written Terms, words such as "Dash", "we", "us", and "our" refer to Dash, the provider of this mobile application. By using and engaging with the Dash app you accept these Terms and Conditions. If you do not agree with these Terms and Conditions, you are not allowed to use our mobile application. Hence, registering a profile with Dash requires your clear consent and acceptance of these Terms.

3.2 Expectations

These Terms are intended to describe how the Dash mobile application functions and what obligations we as a platform are responsible for in our relation to you. The terms include the following:

  • What you can expect from us and our Dash mobile application.
  • What we expect from you and what rules apply for the use of our app.
  • What you can expect from the companies that are present on our platform and in general the interaction between you and a company through our app.

3.3 The Importance of our Terms

We emphasize the importance of reading and understanding these Terms and Conditions before using our app as it will count as your full acceptance and agreement. These Terms and Conditions include all relevant policies (some that might change over time - you will be notified in case) such as our Privacy Policy and our Cookie Policy valid in your country.

4. Using Dash Mobile Application

4.1 How can you get rewarded for your loyalty?

Dash seeks to make it simple and straightforward for you as a consumer to get rewarded for your loyalty towards a certain company. While loyalty clubs and reward programs for long have been a phenomenon among larger corporations, Dash enables the same mutual relationship to grow between consumers and far smaller companies. Our first loyalty product is a digital stamp card, which can be used following the steps below:

  • Find the company on the Dash app and add their digital stamp card to your companies.
  • Visit the store and purchase a product that is rewarded with a stamp on your digital stamp card.
  • Do this continuously as you purchase matching products at your preferred store.
  • At some point you will have collected enough stamps to earn a reward. The reward can be redeemed once in any store associated with the specific company.

Please note that your rewards will expire after 1 year following the earning of the reward. It can also become invalid if the company chooses to terminate their agreement with Dash or if the company goes bankrupt.

4.2 How to Redeem Rewards

To redeem a reward using the Dash app, you must create a profile. The profile provides Dash with relevant data such as name, gender, and date of birth, which will be used to improve your Dash app experience and support your associated companies with a stronger set of data. You can create a profile using one of either identity providers (IdP):

  • Apple
  • Google
  • Meta (Facebook)
  • Mail (This is not an IdP. It requires a manual creation of profile and the data is stored locally with us).

Version 1 of the Dash app only requires a profile for the full use of the app. At a later stage Dash will request your billing information in order to purchase prepaid cards, vouchers, and other similar products.

4.3 What you must never do

  • Log into the app using someone else's details or contact information with the intention of pretending to be someone else.
  • Allow others to use your personal account to access the app or share your login credentials.
  • Falsify or alter your device's GPS/location settings to access location-specific rewards or offers not intended for your actual location.
  • Modify, counterfeit, or tamper with digital stamp cards, coupons, or rewards to gain unearned benefits. Rewards will be authenticated in the reward process.
  • Infringe upon the app's or any third party's intellectual property rights, including copying or distributing content without permission.
  • Abuse customer support services by making false reports, submitting frivolous or vexatious complaints, or using inappropriate language.
  • Use a false first name when creating your profile when creating a profile using the manual email flow.
  • Create a profile using a false email with no link to any real inbox belonging to you.

5. Products associated with Dash

5.1 The role of Dash

As the middleman facilitating an interaction between company and consumer, Dash has no influence on the product type associated with stamps or rewards. This is fully up to the specific company to decide and communicate correctly with the consumer. Dash holds no responsibility for the quality, description, or content of the products associated with the stamps or rewards displayed in the app.

6. Price, payment, and refund

6.1 Price

All prices visible in the Dash app are shown in the currency of the country in which you are located. If you are located in Denmark all prices have VAT included. Prices for prepaid cards are firm and the same for all users, while the prices of specific vouchers might vary as these can be dependent on your loyalty profile. The price only ever represents the specific product(s) described in the Dash app and never includes any additionals such as carrying bags etc.

6.2 Dash as the Payment Recipient

Any payment to a specific company made through the Dash app will be processed by Dash on behalf of the respective company. The companies have authorized Dash to receive these payments from you on their behalf, ensuring full satisfaction of your payment obligation for the prepaid cards or vouchers you pay for, and which are provided by the companies through the Dash platform.

6.3 Payment Process

In the Dash app we offer you more than one method of paying. You can choose to either pay with Apple Pay/Google Pay, MobilePay or directly with the credit card associated with your profile.

Similar to any other digital payment, the paid amount will be wired immediately to Dash. If the transaction is made outside of regular banking hours, we will make a payment reservation in your bank account and complete the transaction whenever the bank reopens. Hence, if possible, the price will be withdrawn immediately from your bank account through the preferred payment method.

6.4 The Interaction Between the Supplier and the Consumer

It is the Supplier, not Dash, who delivers the goods or services that a voucher or a prepaid value card provides access to. To purchase vouchers via the Dash app, you must be at least 18 years old. By paying the price of any product within our app, you confirm that you are 18 years or older.

6.5 Refunds

Dash offers a full refund for the purchase of a prepaid value card if the card is still unused and has been given no stamps. Due to the limitation of vouchers, hence the nature of a company campaign, Dash offers no chance to get a refund for the purchase of a voucher on the Dash app.

In case you feel unfairly treated by Dash, please reach out to us and we will see what we can do to solve the case.

7. User Complaints

7.1 Help Center

Complaints should be submitted through the Help Center in the Profile section of the App before taking any other action. You must include the reason you are unsatisfied and any other information reasonably requested by us.

8. Your Responsibilities

8.1 Your Relationship with Dash

We are unable to cover everything but we have highlighted a few areas that are an important part of your relationship with Dash. As you use our App keep in mind, you are always responsible for the activity that occurs on your Account, and are required to notify us immediately of any change in your eligibility to use or access the App, or any breach of security or unauthorized use of your Account.

8.2 Your compliance

As a condition to use the App and access your Account you are required to comply with all laws and regulations that apply to you at all times in connection with your use of Dash.

8.3 Misconduct

You are expected to show respect for the Store's guests and personnel, as well as employees of Dash. If you act inappropriately towards a Store, other consumers of the Store or Dash, or if you commit a crime against or in the Store in connection with the use of Dash, or violate the code of conduct rules (or similar) of the Store or Dash or any other similar behavior, Dash may, ban, exclude or suspend you from the App permanently. The intervention of Dash does not deprive the Store of the means and rights at its disposal to obtain possible reparations or other remedies. The Store remains entitled to proceed on any further juridical measures towards your misconduct.

8.4 Reviews

At times you may have the opportunity to review Dash or Stores that you have interacted with on the App. Any reviews that you submit through our App must be accurate and never contain any discriminatory, offensive, or defamatory language. TGTG doesn't verify the reviews provided by you or any other consumers that use the App. So keep in mind any reviews you may see displayed in the App may be inaccurate, incorrect or misleading.

8.5 Dash Rules of Conduct

When using the App and accessing your Account you acknowledge that you are responsible for all of your personal activity in connection to the features of the App, which includes your acknowledgment and agreement with the following:

  • To not use the Dash for any illegal purpose or any other purpose that is prohibited by these Terms.
  • You are at least 13 years of age or have been given parental consent to use our App. The parental consent should be documented and possible to provide upon request.
  • You will pay in full any amount displayed on the App to purchase any specific product having a price.
  • As far as possible, you will only purchase limited products (campaign products) that you intend to pick up at the Store.
  • You will not use the App to research Stores or the pricing of Stores.
  • You will not engage in inappropriate behavior towards: (i) a Store including its owners, agents or employees; (ii) another consumer of a Store; or (iii) Dash including its owners, agents or employees.
  • You're not located in a sanctioned country or on a sanctioned persons list.
  • You acknowledge and agree that you have not created other Dash Accounts that have been suspended or terminated by Dash for violations of our terms, policies, or applicable laws or regulations.
  • You will not use any automated systems, robots or software to extract data from the Dash app.

9. Data Use and Privacy

9.1 Collection of Data

Dash values your privacy and works to ensure that it's protected when using our Platform. When you use the Platform we collect and process personal data about you. You can read more about how we collect and use personal data in our Privacy Policy.

10. Indemnity and Limitation of Liability

10.1 Your rights

You agree to indemnify, defend and hold harmless Dash and its parental companies, subsidiaries and affiliates, along with their owners, directors, officers, employees and contractors from and against any and all claims.

11. Intellectual Property (IP)

11.1 What Is Our Property?

The Dash Platform and the services we offer via the App, including all underlying technology, software, graphics, designs and all copyrights, trademarks, service marks, trade names, logo and other intellectual property or proprietary rights contained therein, are and remain our sole and exclusive property.

12. Suspension and Termination

12.1 Our Right to Suspend

We are entitled to suspend or terminate your access to the App including the deletion of your Account at any time at our reasonable discretion without any liability.

13. Miscellaneous

13.1 No Warranties

Our Dash Platform is made available to you on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including any implied warranties of non-infringement, merchantability and fitness for a particular purpose unless you're located in an area that by law provides you a specific right contrary to this disclaimer or does not permit us to exclude a warranty. Otherwise, we're held to only the express promises we make to you in these Terms.

13.2 Blocking your access or refusing to process a payment

Our App will be available for use in many countries throughout the world so different laws may apply in different countries that concern our relationship with you. We may block your access, terminate your Account, or refuse to process a payment if we reasonably believe there's a risk - like a potential breach of a law or regulation - associated with you or a payment. We may take any of these actions without notice. Examples of where we might do this include:

  • Transactions where we can't receive payments from you, your bank or your country.
  • Payments from sanctioned persons or persons located in sanctioned countries.
  • Where we reasonably believe there is a legal or regulatory issue.

13.3 Changes to these Terms

We can make changes to these Terms at any time. If we update these Terms we will notify you in your Account and post them on the Dash Platform. The new Terms will not apply retrospectively to your use of our Dash Platform before the Terms changed, but the new Terms will apply to your continued use of the Dash Platform and your Account after the effective date of the new Terms. Hence, your continued access to or use of the Dash Platform or your Account will constitute acceptance of the revised Terms. If you do not wish to continue using the Dash Platform following the changes to the Terms, you can cancel your agreement to the Terms by deleting your Account.
